Belarus Has Introduced New Rules For Citizens Subject To Travel Restrictions

Alexander Lukashenko signed a decree establishing new procedures for maintaining a database of Belarusian citizens whose right to travel is temporarily restricted. The document was published on the National Legal Internet Portal on July 22.

According to the decree, the Ministry of Internal Affairs remains the owner of the database. It will contain information on citizens for whom a decision has been made regarding temporary restriction on the right to leave the country, its suspension, revocation, or lifting, as well as on permission to leave the country for a specified period. In addition, the database will contain information on court decisions determining the procedure for minors to travel abroad.

The database will include last name, first name, patronymic, date and place of birth, identification number, details of the identity document, information about the authority that issued the decision, as well as information about the restriction itself and its duration. The Ministry of Internal Affairs will transmit information from this database to the State Border Committee at least once a day.

The decree also establishes a citizen’s right to obtain, free of charge, information regarding whether data about them is stored in the database. To do so, they must apply in person to the citizenship and migration division of the internal affairs agencies. A certificate or extract must be issued no later than the next business day.

After being removed from the database or transferred to the archive, the information will be retained for 25 years.

The document will take effect in stages. The provisions establishing the new procedures for maintaining the database will take effect six months after the decree is officially published; the remaining provisions will take effect immediately upon publication.
